Updates from Just Security: Litigation Tracker:

  • Habeas petitions are being filed on behalf of men who have been rendered/disappeared to a Salvador prison.
  • As I previously noted, Associated Press has won a preliminary injunction on First Amendment grounds to allow the news organization to participate in the White House press corps.
  • The state of Maine has challenged the school lunch funding freeze imposed by the US Department of Agriculture in retaliation for Maine's opposition to the Trump administration's transgender ban.
  • The American Library Association and library employee unions have sued to stop the dismantling of the Institute of Museum and Library Services.
  • Cathy Harris of the Merit Service Protection Board has won the en banc review of the DC Circuit appeal of her reinstatement. I.e., until Trump appeals this to SCOTUS, she leads MSPB. In a tandem case, Trump has appealed the ruling reinstating Gwynne Wilcox to the NLRB and SCOTUS has paused that ruling, pending the appeal. I.e. Wilcox is not in at NLRB for the moment. It's possible that by the time you read this, SCOTUS will have booted Harris too.
